The Cases Our North Dallas Medical Negligence Law Firm Handles

Missed and delayed diagnoses, birth injuries, surgical and anesthesia errors, medication errors, pediatric malpractice, and hospital negligence top the list of cases Hastings Law Firm handles in North Dallas. We also take doctor malpractice and dangerous drug injury cases, and in every claim we compare the care in the medical records with what a careful provider would have done.

North Dallas families come to us most with these claims:

  • Misdiagnosis and delayed diagnosis. A test result can go unread, or serious symptoms can be written off as nothing to worry about. Meanwhile, the illness can move past the stage when it was easiest to treat. Our misdiagnosis attorneys and failure to diagnose lawyers compare the symptoms reported at each visit with the tests ordered, to find any visit that missed a needed test.
  • Surgical errors. An operation can damage a structure outside the surgical plan, or warning signs after the procedure can be missed. Another operation and additional recovery time can follow. AHRQ’s Patient Safety Network lists wrong-site surgery as a never event, one that is serious, clearly identifiable, and usually preventable. In surgical error cases, our lawyers compare the operative report with the surgical plan to see whether the damage happened outside the planned procedure.
  • Birth injuries. Changes on the fetal monitor that show a baby in distress can go unnoticed, or a needed cesarean can be put off too long. Parents can then face years of therapy, equipment, and support as their child grows. The chart usually shows when a cesarean was decided on and when it began, and our birth injury lawyers measure that gap against what the fetal heart tracing showed.
  • Medication errors. Drug interactions can go unchecked, and a patient can be given the wrong strength or a medicine prescribed for someone else. The harm can range from a reaction that needs urgent treatment to lasting organ damage. In medication error claims, our attorneys compare every dose the patient received with the order behind it and look closely at any mismatch.
  • Anesthesia errors. An anesthesia dose can be miscalculated for the patient’s size or health, or the team can fail to respond when breathing slows or oxygen falls during sedation. A brain deprived of oxygen for even a few minutes can suffer permanent damage. Our anesthesia error lawyers measure each dose on the anesthesia record against the patient’s weight and medical history and flag any amount that was unsafe for that patient.
  • Pediatric malpractice. Parents can describe a child’s worsening symptoms at visit after visit without anyone recognizing them, or a specialist referral can come too late. Harm in the growing years can last a lifetime. The vital signs and growth measurements from each visit help our pediatric malpractice attorneys see when the numbers called for action, and whether anyone acted.
  • Hospital negligence. When a unit is short of nurses, or a warning is lost in a shift change, a patient’s decline can go unnoticed. Bedsores, infections, and falls that care should have prevented can each add days to a hospital stay. Our hospital negligence attorneys read the nursing chart one shift at a time for the hours a patient went without a recorded assessment.

These are the most common medical malpractice claims we see in North Dallas, but they do not represent every case type we accept. If a different medical error has harmed you or someone you love, one of our North Dallas medical malpractice lawyers can look into what happened.

How Our North Dallas Medical Malpractice Lawyers Handle Your Claim

Families who bring a claim to Hastings Law Firm get a medical malpractice lawyer in North Dallas who finds out what went wrong and keeps them informed. Our attorneys review the records with our medical professionals, bring in medical experts where a case needs them, and take the claim toward a settlement or a jury’s verdict.

Every claim traces back to a place where care was given, such as a family practice, a walk-in clinic, a surgery center, or a hospital. On the north side of the Dallas area, many families receive care at Medical City Dallas or Methodist Richardson Medical Center. Farther north, many are treated at Medical City Plano or Texas Health Presbyterian Hospital Plano. Others are seen at smaller hospitals, clinics, and practices across Collin and Denton counties.

Whatever the setting, the first call goes to our intake team, where someone asks about the treatment, when it happened, and which providers were involved. We then gather your medical records at no cost to you, and our attorneys and medical professionals study them.

The records sometimes show plainly what happened. In other cases we ask a medical expert to review the care, often a specialist from the provider’s own field. A specialist can say what the accepted standard of care required in that field. Because Texas Civil Practice and Remedies Code Chapter 74 generally requires an expert report early in a lawsuit, our experts join the review from the start.

When that review is done, we give you a straight answer. If the records do not support a claim, we explain why, and you may still have other options, such as a complaint about a physician to the Texas Medical Board.

If the law supports a claim, we give each provider the written notice Texas requires and then file suit. The county is generally one where a substantial part of the events behind the claim occurred, under Section 15.002, the Texas rule on where a suit is filed. For North Dallas, that can mean Dallas, Collin, or Denton County.

In Dallas County, the civil district courts and the District Clerk are in the George L. Allen, Sr. Courts Building, 600 Commerce Street, Dallas, Texas 75202. The clerk’s office is in Suite 103. Collin County’s district courts sit in the Russell A. Steindam Courts Building, 2100 Bloomdale Road, McKinney, Texas 75071. Denton County’s district courts are at 1450 East McKinney Street, Denton, Texas 76209.

Appeals from Dallas and Collin County district courts generally go to the Fifth Court of Appeals in Dallas, at 600 Commerce Street, Suite 200, Dallas, Texas 75202. Denton County appeals generally go to the Second Court of Appeals in Fort Worth, at 401 West Belknap Street, Suite 9000, Fort Worth, Texas 76196.

From filing through settlement talks or trial, our board-certified patient advocates stay in touch with you. When something noteworthy happens, they tell you what it means, and they answer any question you bring them.

Why Hire Hastings Law Firm for a Medical Negligence Claim in North Dallas?

Hastings Law Firm specializes solely in medical malpractice cases, including birth injury, dangerous pharmaceutical and medical device litigation. With that single focus, our North Dallas lawyers know the Texas rules for these claims and the defense attorneys and insurers on the other side.

Every case we handle, for families across Texas and in other states, adds to what our lawyers bring to a North Dallas family. A large part of that is knowing how the defense works.

Lawyers Who Know How Malpractice Claims Are Defended

At Hastings Law Firm, our former malpractice defense attorneys map out the arguments a North Dallas claim will face before a lawsuit is filed. We gather the evidence to answer those arguments from the first records request, so the claim is ready when the defense raises them.

The defense may blame the harm on an earlier illness, call it a known risk of the procedure, or argue that the care met the standard. The evidence we gathered early answers each of those points. Our experts also prepare for the testimony the defense’s experts are likely to give, which matters if the case goes to trial.

Innovation and Trial Preparation

On the day Hastings Law Firm accepts a North Dallas medical malpractice claim, our attorneys begin building it for a courtroom. They gather the evidence carefully, choose experts who can make complicated medicine clear, and tell clients what to expect.

Our attorneys have tried these cases to verdict, so any insurer negotiating with us must account for a jury. When an offer is too low, the family has a case that is ready for trial.

That readiness also comes from Florence, the AI tool our own attorneys designed and built from decades of combined medical and legal experience. Records can run to thousands of pages, and our attorneys and medical professionals use Florence as a second set of eyes on them. They then examine the new angles and concerns it adds.

Families get answers sooner because of it, and our lawyers can act quickly when a filing deadline is near. Every innovation at our firm, Florence included, is built for the people who hire us.

The Resources to See Every Case Through

What Determines a Valid Medical Malpractice Claim in Texas

A valid Texas medical malpractice claim must prove the provider had a duty to the patient, failed to meet the standard of care, and caused an injury and damages. The Texas Supreme Court listed those elements in Windrum v. Kareh. Claims that a physician or health care provider fell below accepted standards and caused injury or death come under Chapter 74 of the Texas Civil Practice and Remedies Code.

Medicine carries risk, and a bad outcome is not always negligence. Medical bills and lost wages are recoverable in a claim that meets the elements, and so is noneconomic harm such as pain. The experts these lawsuits need are costly, so a claim with small damages may not justify the expense. Each element gets a fuller explanation in our overview of Texas medical malpractice law.

North Dallas Medical Malpractice FAQs

The two-year deadline to file a medical malpractice lawsuit in North Dallas generally starts when the negligent care occurred, or when the course of treatment behind the claim ended. Texas Civil Practice and Remedies Code Section 74.251 sets that rule, which also covers the end of a hospitalization. The same section adds a ten-year outer limit, called a statute of repose, counted from the negligent care.

For a child hurt before turning 12, Section 74.251 generally extends the deadline to the child’s 14th birthday. Under the open-courts guarantee in the Texas Constitution, that rule can give way when it would end a child’s claim before the child could sue on his or her own. Notice sent to each provider before suit, following Section 74.051 and including the medical authorization under Section 74.052, can pause the deadline until 75 days after it is given. Our guide to Texas medical malpractice filing deadlines goes further into the exceptions.

No Texas Medical Board complaint is needed before suing for medical malpractice in North Dallas. Chapter 74 of the Texas Civil Practice and Remedies Code, which governs these lawsuits, lists no such step. The board handles complaints about the physicians it licenses, a process apart from a civil claim.

The board’s process can lead to discipline of a physician’s license, and it does not replace a malpractice lawsuit. A patient seeking compensation should discuss a separate civil claim with a lawyer. The board’s page on filing a complaint is available online.

You can file a North Dallas medical malpractice claim for your child as next friend under Texas Rule of Civil Procedure 44 when the child has no legal guardian. The term “next friend” means the person who sues for someone unable to sue alone. An incapacitated adult’s court-appointed guardian of the estate may sue under the Texas Estates Code, or a next friend may sue if there is no guardian.

Family ties alone do not create the right to file for someone else. A child’s claim also has its own filing deadline under Section 74.251, and that deadline needs individual review for each child.

Two kinds of loss make up a North Dallas medical malpractice claim’s value, one financial, such as medical bills and lost pay, and one personal, such as pain. Texas Civil Practice and Remedies Code Section 74.301 caps only the second kind, noneconomic damages, for each claimant. Physicians and other individual providers share one limit, institutions face another, and a combined limit applies when two or more institutions are liable.

Section 74.301 leaves financial losses uncapped, and for an injury that calls for long-term care those losses can make up much of a claim’s value. Our explanation of Texas damage caps walks through each limit, though no lawyer can promise what a particular claim will recover.

After a fatal medical error in North Dallas, Texas Civil Practice and Remedies Code Chapter 71 can allow a wrongful death claim and a survival claim. The wrongful death claim benefits only the surviving spouse, children, and parents. The survival claim, brought for the patient’s estate, keeps alive the patient’s own claim for the injury.

In a wrongful death or survival claim against a physician or health care provider, Section 74.303 limits each claimant’s total damages to an amount adjusted for inflation. That limit leaves out expenses for necessary medical, hospital, and custodial care. The family members entitled to each claim are named in our guide to wrongful death claims after medical malpractice in Texas.

No fixed timeline governs a North Dallas medical malpractice case. Whether the patient’s long-term condition is clear yet often sets the pace, along with the number of providers named and how hard the medical questions are. Settling can also shorten a case that would otherwise go to trial.

Texas law requires two early steps, written notice at least 60 days before suit and an expert report generally due 120 days after each defendant answers. A review of your records lets our attorneys give you a clearer picture of the timeline.
