Popular Stool Softener Recalled Over Risk of Infection

Rugby-brand Diocto Liquid – a stool-softening product manufactured by PharmaTech LLC (Davie, FL) – has been voluntarily recalled by the manufacturer over a risk of contamination. All Diocto Liquid NDC 0536-0590-85 is included as part of the recall. According to the Food and Drug Administration (FDA), PharmaTech LLC is taking measures to identify consumers who may have purchased the affected product and alert them of the recall. The recall follows at least two “adverse event reports” of Burkholderia cepacia infections from individuals who utilized the product.

What is a Burkholderia Cepacia Infection?

Burkholderia cepacia is a group of bacteria that is common in water and soil. Although the bacteria is generally not a threat to a healthy adult, it can be dangerous – even deadly – for individuals with compromised immune systems and/or who suffer from conditions such as cystic fibrosis or other chronic conditions of the lung. The Centers for Disease Control and Prevention (CDC) indicate that Burkholderia cepacia infections have a mortality rate of approximately 40 percent. In other words, for every ten individuals who contract a B. cepacia infection, the CDC would expect that at least four of these individuals would die as a result.

A B. cepacia infection is insidious partly because the signs and symptoms of the infection – fever, coughing, wheezing, and/or congestion – are common signs and symptoms of a variety of diseases and conditions. What is more, B. cepacia is resistant to antibiotics and is, therefore, more difficult to treat than the “standard” bacterial infection.

What Do I Do if I Purchased Rugby-Brand Diocto Liquid?

The manufacturer of Diocto Liquid has initiated efforts to contact customers who may have purchased the affected product and arrange for a return of the product. Customers, consumers, and/or purchasers of Diocto Liquid are advised to discontinue use of the product immediately and return any remaining product they may have to PharmaTech LLC and Rugby Laboratories as soon as possible. Consumers who have questions about the Diocto Liquid recall or where they can return product to are encouraged to contact Rugby Laboratories’ Customer Support Department by calling (800) 645-2158.

Do I Have Legal Recourse as a Result of This Recall?

Of course, this recall is of little value if you or a loved one have utilized Diocto Liquid and have contracted a B. cepacia infection because the product was contaminated. In this instance, you may have legal rights to compensation against the manufacturer of Diocto Liquid. This compensation may be useful in addressing any medical bills, treatment costs, lost wages, or any other expense you may have experienced as a result of your B. cepacia infection.

Manufacturers are responsible for creating and distributing products that are safe for use by consumers. Failing to take reasonable measures to ensure this occurs (in other words, failing to take reasonable steps to ensure a product is not contaminated with a bacteria strain) can lead to liability for the manufacturer. It is important that you obtain prompt and competent legal representation if you or a loved one have been injured due to a B. cepacia infection after using Rugby-brand Diocto Liquid.
