Failure to Diagnose Cancer
Mr. Hastings handled this case in which the Plaintiff was seen by his primary care physician for a knot on his chest. The primary care physician sent him for an ultrasound, but not a mammogram. The radiologist read the ultrasound as a collection of fact with no concerns for cancer. Five years later, the Plaintiff was diagnosed with Stage 4 male breast cancer. The firm’s investigation determined that the radiologist had misread the ultrasound film and that a tumor should have been diagnosed. Further, the primary care physician should have ordered a mammogram, not an ultrasound as well as examined the area during visits over the next five years. The case was settled shortly before trial and a trust was created for the Plaintiff’s family for their needs. Unfortunately, the Plaintiff succumbed to his cancer months after the settlement. He was able to go with the peace of mind that his family was provided for after his passing.
