What Determines a Valid Medical Malpractice Claim in Texas

A valid Texas medical malpractice claim must prove the provider had a duty to the patient, failed to meet the standard of care, and caused an injury and damages. The Texas Supreme Court listed those elements in Windrum v. Kareh. Claims that a physician or health care provider fell below accepted standards and caused injury or death come under Chapter 74 of the Texas Civil Practice and Remedies Code.

Medicine carries risk, and a bad outcome is not always negligence. Medical bills and lost wages are recoverable in a claim that meets the elements, and so is noneconomic harm such as pain. North Dallas Medical Malpractice FAQs

The two-year deadline to file a medical malpractice lawsuit in North Dallas generally starts when the negligent care occurred, or when the course of treatment behind the claim ended. Texas Civil Practice and Remedies Code Section 74.251 sets that rule, which also covers the end of a hospitalization. The same section adds a ten-year outer limit, called a statute of repose, counted from the negligent care.

For a child hurt before turning 12, Section 74.251 generally extends the deadline to the child’s 14th birthday. Under the open-courts guarantee in the Texas Constitution, that rule can give way when it would end a child’s claim before the child could sue on his or her own. Notice sent to each provider before suit, following Section 74.051 and including the medical authorization under Section 74.052, can pause the deadline until 75 days after it is given. No Texas Medical Board complaint is needed before suing for medical malpractice in North Dallas. Chapter 74 of the Texas Civil Practice and Remedies Code, which governs these lawsuits, lists no such step. The board handles complaints about the physicians it licenses, a process apart from a civil claim.

The board’s process can lead to discipline of a physician’s license, and it does not replace a malpractice lawsuit. A patient seeking compensation should discuss a separate civil claim with a lawyer. The board’s page on filing a complaint is available online.

You can file a North Dallas medical malpractice claim for your child as next friend under Texas Regla de Procedimiento Civil 44 when the child has no legal guardian. The term “next friend” means the person who sues for someone unable to sue alone. An incapacitated adult’s court-appointed guardian of the estate may sue under the Texas Estates Code, or a next friend may sue if there is no guardian.

Family ties alone do not create the right to file for someone else. A child’s claim also has its own filing deadline under Section 74.251, and that deadline needs individual review for each child.

Two kinds of loss make up a North Dallas medical malpractice claim’s value, one financial, such as medical bills and lost pay, and one personal, such as pain. Texas Civil Practice and Remedies Code Section 74.301 caps only the second kind, noneconomic damages, for each claimant. Physicians and other individual providers share one limit, institutions face another, and a combined limit applies when two or more institutions are liable.

Section 74.301 leaves financial losses uncapped, and for an injury that calls for long-term care those losses can make up much of a claim’s value. Our explanation of Texas damage caps walks through each limit, though no lawyer can promise what a particular claim will recover.

After a fatal medical error in North Dallas, Texas Código de Procedimiento Civil y de Recursos Capítulo 71 can allow a wrongful death claim and a survival claim. The wrongful death claim benefits only the surviving spouse, children, and parents. The survival claim, brought for the patient’s estate, keeps alive the patient’s own claim for the injury.

In a wrongful death or survival claim against a physician or health care provider, Section 74.303 limits each claimant’s total damages to an amount adjusted for inflation. That limit leaves out expenses for necessary medical, hospital, and custodial care. No fixed timeline governs a North Dallas medical malpractice case. Whether the patient’s long-term condition is clear yet often sets the pace, along with the number of providers named and how hard the medical questions are. Settling can also shorten a case that would otherwise go to trial.
