Appeals from Harris and Fort Bend County district courts generally go to the First or Fourteenth Court of Appeals, both at 301 Fannin Street, Houston, Texas 77002.

What Determines a Valid Medical Malpractice Claim in Texas

A valid medical malpractice claim in Texas will prove that a duty of care existed, that a breach of the standard of care happened, and what damages the breach caused. The Texas Supreme Court set out those negligence elements in Windrum v. Kareh. Chapter 74 of the Texas Civil Practice and Remedies Code governs these claims when they allege that a physician or health care provider departed from accepted standards.

A bad outcome alone does not meet the requirements for a malpractice case. But when the elements are met, compensation can cover economic losses, such as medical bills and lost income, and noneconomic losses, such as pain. Houston Medical Malpractice FAQs

You generally have two years to file a medical malpractice lawsuit in Houston, counted from the negligent care or from the end of the related course of treatment. Section 74.251 of the Texas Civil Practice and Remedies Code sets that deadline, and a separate ten-year limit, called a statute of repose, generally applies as well.

Before filing, a patient must send each provider being sued written notice by certified mail at least 60 days in advance, under Section 74.051. The notice must include the medical authorization Section 74.052 requires, and notice given as the statute provides pauses the deadline for 75 days. After suit is filed, an expert report is generally due 120 days after each defendant’s original answer. You can bring a medical malpractice claim in Houston for a family member when Texas law lets you act for that person. Under Texas Regla de Procedimiento Civil 44, a parent may bring a child’s claim as next friend when the child has no legal guardian. A guardian of the estate may sue for an incapacitated adult, or a next friend may act if there is no legal guardian.

Being a relative does not by itself give that authority. Under Section 74.251, a child injured before age 12 generally has until his or her 14th birthday to file. The Texas Constitution can limit how that deadline applies to a young child. Each child’s deadline needs individual review.

A signed consent form does not settle whether you can bring a medical malpractice claim in Houston. What the form disclosed and whether the care met the applicable standard are separate questions. Under Sections 74.101 to 74.106 of the Texas Civil Practice and Remedies Code, the Texas Medical Disclosure Panel determines which risks of medical care must be disclosed.

A lawyer can review both questions. Informed consent means the risks of a treatment were explained and the patient agreed to it. Texas does not require the same written disclosure for every procedure, so our lawyers read the signed form alongside the rest of the medical records.

The value of a medical malpractice case in Houston depends on economic losses, like medical bills and lost income, and noneconomic losses, like pain. Section 74.301 of the Texas Civil Practice and Remedies Code caps noneconomic damages per claimant, with separate limits for physicians and for health care institutions. A combined limit applies when more than one institution is responsible.

Your family can bring a claim after a loved one died from medical malpractice in Houston, under Capítulo 71 del Código de Prácticas y Recurso Texas Civil. A wrongful death claim is for the exclusive benefit of the surviving spouse, children and parents. A separate survival claim carries on the claim the patient could have brought had he or she lived.

Under Section 74.303, these claims against a physician or health care provider carry an inflation-adjusted damages limit per claimant. There is no set length of time for a medical malpractice case in Houston. Every case is different, and each one’s length depends on the number of providers involved, the medical questions, and whether the full effects of the injury are known. Whether the case settles or goes to trial also shapes how long it takes.
