Failure To Diagnose Hernia Leads To Medical Malpractice Lawsuit
On behalf of Hastings Law Firm posted in Lawyer in Houston for Failure to Diagnose on Monday, May 23, 2016.
The knowledge that a loved one’s death could have been prevented had doctors not failed to diagnose a seemingly obvious condition is often devastating. Although a lawsuit and a monetary award cannot change the result of a doctor’s failure to diagnose, holding negligent doctors accountable may help to ease the financial burden caused by unanticipated expenses and any loss of income. Texas residents retain the right to file medical malpractice lawsuits in similar circumstances.
Following the 2014 death of a 54-year-old man in another state, his daughter and his wife recently filed a medical malpractice lawsuit naming several defendants, including a medical center and four doctors. According to the complaint, the man reported to the medical center’s emergency room with abdominal pain and constipation in Oct. 2013. A CT scan was performed, and the plaintiffs allege the doctors failed to recognize clear indications of the possible hernia.
It is further alleged that the patient’s medical history, including a 2004 gastric bypass surgical procedure, should have raised red flags, but was disregarded. Without proper diagnosis, the man was sent home. Five months later his condition remained undiagnosed. By then, his weight had dropped by 80 pounds, and his loved ones claim he continued to suffer excruciating pain until septic shock led to organ failure that ultimately caused his death in July 2014.
Proving the failure to diagnose a medical condition is complicated, and many Texas residents choose to seek the guidance and support of experienced medical malpractice attorneys to pursue financial relief after the untimely deaths of loved ones. With their main law offices in Houston Texas, the Hastings Law Firm have represented 100s of failure to diagnose victims across Texas and have earned the distinction of being one of the best medical malpractice lawyers in Texas. Not only will a lawyer work to protect the legal rights of a client, but he or she may have easier access to documented evidence of negligence by a medical professional. Establishing negligence is vital for the successful presentation of such a claim and could lead to a monetary judgment for the financial and emotional damages sustained.
