Failure to Diagnose Bowel Obstruction

Greg Feste handled this medical malpractice case involving claims that the general surgeon failed to recognize and treat a worsening bowel obstruction. After several days, the family moved the patient to another hospital. She was promptly taken to the operating room and was diagnosed with necrosis of small and large bowel, volvulus of small bowel with evidence of internal hernia, acute mesenteric ischemia, septic shock, lactic acidosis, and acute renal failure. Due to the delay in treatment, the patient had to have several procedures including extensive removal of her intestines and a colostomy. This resulted in short gut syndrome and likely required lifelong parenteral nutrition. The case was settled before trial for a confidential amount that provided for the client’s long-term care needs.

Failure to Use Bed Alarm on Geriatric Unit Caused Brain Trauma

Greg Feste handled this medical malpractice case involving claims that the nursing staff at a Texas hospital caused a fall resulting in a brain bleed and permanent neurological damage. Despite being labeled a high fall risk in the geriatric unit, a bed alarm was not used. The patient was found on the floor with broken glasses on her face. The head trauma from the fall caused an intracranial hemorrhage and permanent right sided weakness. The case was settled before trial for a confidential amount.

Failure to Diagnose Perforated Bowel After Gastric Sleeve Surgery

Greg Feste handled this wrongful death medical malpractice cases alleging failure to diagnose a perforated bowel after the 17-year-old patient underwent vertical sleeve gastrectomy. Following surgery, the patient complained of abdominal pain and tenderness. Despite these complaints, she was discharged home. The patient returned to the ER a few days later and was diagnosed with severe septic shock and passed away. Autopsy concluded that she died from acute peritonitis due to the perforation of the small bowel following a laparoscopic vertical sleeve gastrectomy. The case settled shortly after filing the lawsuit for a confidential amount.

Failure to Diagnose Perforated Bowel After Hernia Surgery

Greg Feste handled this wrongful death medical malpractice cases alleging delayed diagnosis and negligent treatment of two bowel perforations after a ventral hernia repair surgery. Postoperatively, the patient was lethargic, tachycardic with an elevated white blood count. By the time the surgeon took the patient back to the operating room, the patient was already septic and eventually died from severe sepsis. The case was settled before trial for a confidential amount.

Negligent Gallbladder Surgery

Greg Feste handled this medical malpractice case involving claims that the surgeon failed to properly identify the anatomy during a laparoscopic cholecystectomy and negligently cut the common duct and common hepatic duct. The client returned to the ER a few weeks after surgery complaining of nausea and vomiting. She was diagnosed with a bile leak and underwent several procedures to reconstruct her biliary system. The case was settled before trial for a confidential amount.

Negligent Vancomycin Monitoring

Greg Feste handled this medical malpractice case involving claims of a nursing home and her physicians’ failure to monitor the trough levels of a patient on vancomycin. As a result, the patient continued receiving vancomycin even though her levels were outside of the therapeutic range. The patient had to be hospitalized for acute kidney injury as a result of vancomycin toxicity. The case was settled before trial for a confidential amount.

Alvarado v. Patel MD—Negligent Warfarin Monitoring Led to Stroke and Death

Greg Feste and Tommy Hastings tried this medical malpractice case in Harris County. Dr. Patel was treating Mrs. Alvarado for a-fib with Warfarin, an older, relatively inexpensive anticoagulant that requires frequent blood draws to monitor levels. Plaintiffs’ alleged that she was on Warfarin because Dr. Patel failed to complete the insurance paperwork for her to get Xerelto, a newer anticoagulant that doesn’t require monitoring blood levels and frequently adjustments. At trial, experts on both sides admitted that you had to check the PT/INR levels when taking Warfarin but disagreed on at what frequency. The jury unanimously found that Patel’s negligence proximately caused Alvarado’s death. It awarded the trial plaintiffs $684,000. Patil’s liability for noneconomic damages was capped at $250,000 under Chapter 74 of the Texas Civil Practice and Remedies Code.

Negligent Gallbladder Surgery

Greg Feste handled this medical malpractice case involving a routine laparoscopic cholecystectomy (gallbladder removal) in which the surgeon misidentified the anatomy and transected the hepatic artery, hepatic vein, and common bile duct. This caused the patient to need a liver transplant and extensive surgery to repair the bile ducts. The case settled shortly after filing the lawsuit for a confidential amount.
